The Trial

After reading this anyone that thinks justice is in the best interests of the children and not for the obvious results, profit, has an agenda to conceal the truth.
The first ties into the last.
The first. I was subpoenaed as a witness by the plaintiffs lawyer. In case you`re not aware of Cdn court rules that means I could not present any evidence or say anything in court unless it was to answer a question by the exs lawyer. If I said anything the judge was required (gleefully) to ignore it. I did have two section 15 custody and access reports present. The court counselors recommended shared custody while the expert independent assessment recommended split custody, two weeks for the children with each parent continuously.
The reports took a total of three years to complete but the judge decided that because they were now six months old at trail date they were stale dated, not to be used. I found this particularly interested because when asked by her own lawyer on whether she had ever denied access she said "no". She admitted to the Dr. that she had repeatedly denied access for no reason and this was noted in his report.
The judge commented that she must have had a reason. The only place the judge would have found out she had denied access was in the stale dated report that the judge refused as evidence. The judge knew she lied in court but excused it with `she must have had a reason`. Perhaps I misunderstood the judges comment, perhaps the judge was saying she must have had a reason to lie to her and it wasn`t about denying access. Is this a case where two wrongs make a right? Apparently in the courts eyes it is.
The last. Because I could not present evidence or even speak on my childrens behalf I filed for an appeal to the sole custody decision. I was refused on the grounds `the judge heard enough from your ex to make her judgement`.
This is the way the justice industry in Canada works. The best interests of the child or creating the potential for profit.
Shouldn`t be a hard call.

Access or Abuse

Society abhors child abuse yet in Canada it`s sanctioned and supported on a wide spread scale, see link below.
My children were constantly abused physically and mentally. The first time they told me they were slapped to the ground simply for asking to see me I reported it to the police and spent the night in jail.
The next two times it was reported to the police with no encouragement from me. When the police failed to take action and it happened again I suggested to the children they try the childrens help line. This took the complaint to the Ministry of children and Family where they hide the complaint from the police. Eventually they started running away but were always returned to the abuser and punished for telling. I decided that the only way to end the abuse was for me to leave, so they wouldn`t be asking to see me. After a few years I came back in the hopes the situation had changed, nope.
You won`t believe the chain of events that cascaded from my return, precipitated by the justice industry, it`ll be in the book.

So much for the governments claim that `only a few children slip through the cracks`.

The Ludicrous

Before I was diagnosed with cancer in 1995 I had the children three days a week as weekend work was my busiest time. Even though the mother of my children quit her job and was home all week she didn`t like the idea she couldn`t party on weekends so she had the order changed to every other weekend. Then she discovered that she could pay people with the child support she received to take the kids for the weekend. I`m sure both children remember well all the weekends they spent at other peoples houses. Imagine that, I`m paying her to keep the kids away from me and even more ludicrous, the Cdn government says this is the most important thing to a child of divorce.
You`ll have to wait for the book to find out what the ludicrous response from the courts was and how it played out.

The Consequences

I`ve touched on child support but I`ll save the really interesting information for the book, consider this the condensed version with each post a book section.
The Consequences
I suspect most Cdns have yet to realize, or perhaps they believe the`re insulated from the serious consequences a corrupt justice industry has on their personal situation.
Recently a report came out that placed Vancouvers property crime rate at the highest in North America. No surprise to those that have been exposing why. Four times higher than New York City and that`s based on reported crime, not the estimated 6 out of 7 that are not reported, in reality it`s astronomical.
Here`s the breakdown, my complete analysis in the book will also be based on statistics for accuracy.
Statistically 80% of crime is rooted in a child denied a parent, usually the result of sole custody.
The current record high incidences of crime committed is by the generation that are, or will be, the parents of a historical first, a generation of youths that are outnumbered by seniors that will drive health care costs to quadruple. To top that they are also the leading edge of the highest sole custody rate creating the highest number of children denied a parent, the root cause of crime. lol, I can already hear the poopaas. Your thinking there are lots of things that will nullify the results of the highest number of youth problems in a generation outnumbered by seniors, like the economy.
Greed is the root of evil in our justice industry and a good economy, historically, has also been the salvation. As of today Vancouver has gone through it`s best economic boom ever with labour shortages creating excellent work incentives, yet crime is on the rampage, a complete reversal of historical trends. You say np, the police are being `restructured` and our economy is strong so we`ll pull through even though crime has not responded to our strong economic conditions which I stress is a historic first.
Our economy has gone from manufacturing to raw resource exporter in the last five years. As the global economy and markets slow China will reduce demand dramatically. They will be only too happy avoid further expansion as markets contract and concentrate of stabilizing their recent rapid growth that has lead to the explosion in commodity prices. The Cdn government has no influence on global prices They, like us are just riding along with the wave of global demand. As demand falls revenue will decrease along with government job creation. Did I forget to mention our employment rate looks so good due entirely to government hiring, not the private sector creating jobs.

We`ve heard from Cdn governments our economy is strong even if global demand drops off. The argument that seems to be widely believed is simply not believable. They say even if global demand drops off China will continue to consume large amounts of raw resources suppling their own countries demand for finished goods keeping commodity prices up. Consider this, Walmart is China's 7th largest trading partner. With Cdns owing $1.25 for every $1.00 in assets and in debt for $1T, $50B in credit card debt, $250M in personal loans and Americans $10T in debt retailers like Walmart will soon be cutting way back. The amount of goods produced in China already vastly out supplies their own demand. Even if it didn`t why would they continue to expand to supply their own market when consolidation would bring commodity prices down when high prices are the result of overall global demand and not internally.
When I first started writing about future events I said Ontario would take the first and biggest hit. The`ve been shedding jobs since 2002. Now I`m saying the rest of Canada will now feel the effects because the problems that our federal government has persistently avoided.
Cause and effect will be detailed in the book.

Foreclosures have soared to record highs and probably will keep rising.
This is not just a US problem. Canada is not insulated from trouble in our main source of revenue, falling commodity prices. Canada, Europe, UK and other countries have been bailing out the mortgage holders on subprime and ABCP. The results are in, we are facing a major global slowdown that will put the Cdn economy in a situation that historically increases crime which is already at historic highs.

London's property market hit what was widely regarded as a peak of insanity in January when a six-square-metre storage room in a basement in the tony Knightsbridge district sold for the equivalent of US$335,000. By December, British home prices were reported to have fallen during the month by the most in three years amid fears of a crash in 2008.

The current situation in the US replicates our Cdn 80`s housing crash. The rumour originating in the real estate offices that housing will stay strong until interest rates spike up as was the case in the 80`s is false, inflation combined with a broke consumer is the culprit, not interest rates.

Whos your (dead beat) daddy?

The only time I`ve ever threatened my ex with anything, I told her if the children don`t ask I won`t talk, if they ask I`ll give them the shortest possible answer but `if they are lied to I`ll make sure they know the truth`.
Here`s the truth, deal with it.
I keep thinking back to my son telling me his stepfather saying I`m a dead beat dad because I didn`t work and pay child support. It`s time to deal with it.
Recently I showed my daughter a 1998 court order that released ALL of the proceeds of the sale of the T Lake property to Ms. B****. This came about because of a previous court order that I approved of using the sale proceeds to pay off any arrears in child support accumulated due to my being out of the work force in 1996 with cancer. For final calculations you might want to note that I was not obligated to pay during this two and a half years. Even though the judge responded to her request in 1996 to pay anyway through the sale proceeds with, `this is very unusual`, meaning I wasn`t obligated to pay. I said to the judge `they are my children and I`ll pay regardless`.
By 1998 the arrears amounted to just over $17,000 while my share of the sale of the property amounted to just over $24,000. Discounting the time I was not obligated to pay but did so on a voluntary basis the arrears amount would only have been $2,000. Apparently it wasn`t good enough that I pay the extra $15,000 but that the whole $24,000 of my share be turned over. Just to set the record straight I only legally owed $2,000, since that time I`ve been on a disability pension which I`m not obligated to pay child support. It does leave three years where I was, bringing the grand total of support owed to $20,000. By my calculation that still leaves me with a credit of $4,000 yet I`m still deeply in arrears. The reason I`m in arrears is because Ms. Baker failed to notify Family Maintenance Enforcement Program that I paid the full amount plus an extra $7,000. According to FMEP if a payee does not notify FMEP of a payment they are no longer entitled to FMEP assistance. Yes I did talk to them, they didn`t care.
btw that final figure does not include the 1995 agreement where I turned over my $250,000 share of the company I owned `in leu of child support` which are the exact words signed by Ms. Baker to the agreement.
This is only one of many atrocities committed and approved by a very corrupt justice system.

I should add during the three years I was able to work FMEP sent out a letter to all past and potential employers threatening that if they hired me and didn`t withhold 50% of my earning they would be prosecuted. Consequently and although I had a very good work reputation no one would hire me as they though someone making half the rate of the rest of the crew would cause trouble.
If you want to know what that means in dollars a $5,000/month job at a 34% tax rate which is average for me would send $2500 to FMEP and $1700 in taxes leaving me with $800/month. Work expenses alone cover most of that let alone rent or food, and that`s even with the fact that I don`t owe anything, in fact I have a credit in support.

There is no end to the reprehensible methods the justice industry will go to in ensuring the non-custodial parent is too broke to be a parent. Nothing too underhanded, unlawful and sometimes downright evil in the name of increased profits through parent denied children.

If the Cdn government thinks the police need restructuring it`s hard to believe they think a justice industry that is rotten to the core is just fine.
